TRAVELING WITH BALLENTINE PHOTO CONTEST

Official Rules
This Contest promotion is in no way sponsored, endorsed, administered by, or associated with Instagram™, Twitter™, or Facebook™. You understand that you are entering a contest sponsored by Ballentine Vineyards (“Sponsor”) and not by Instagram, Twitter or Facebook. No wine purchase necessary to enter or win.

Eligibilty: Ballentine Vineyards', Traveling with Ballentine Photo Contest is open to United States residents age 21 years or older, except for employees, affiliates, and family members of Ballentine Vineyards emplopyees. Family members include spouses, parents, siblings, children, son-in-law, daughter-in-law, all lineal descendants, including those by adoption, or any other household member.
 
Ballentine Vineyards', Traveling with Ballentine Photo Contest is governed by the laws of the United States and void where prohibited by law. All federal, state and local rules and regulations apply. Ballentine Vineyards will make all decisions regarding the interpretation and application of these official rules. All decisions are final and discretionary. Promotion is void where prohibited or restricted by law. 
 
Entry: Contestants must enter online between June 1, 2017 and September 1, 2017. The entry period begins on 6/1/2017 and ends at 11:59:59 p.m. ET on 9/1/2017. Early and late entries will not be considered. There is no limit on the number of photos a contestant may submit.

To enter: 1) Be a follower of the Ballentine Vineyards Instagram, Facebook or Twitter accounts. 2) Upload a photo of you, your ballentine wine or your adventure to Instagram, Facebook, or Twitter during the promotion schedule. 3) Include tag @BallentineVineyards and the hashtag #TravelingWithB 
 
Judging: Photographs that showcase you or your adventures enjoying Ballentine wines will be judged on their incorporation and depiction of the “Traveling with Ballentine” theme, quality, originality, and creativity. Any photo that is uploaded to Instagram, Facebook, or Twitter during the Entry Period, which contains the required tag and hashtag, shall be deemed to be an intentional entry in the Contest, subject to these Official Rules. Please email holly@ballentinevineyards.com if you believe your photo has been used without your actual or deemed consent.
 
Requirements: Each entrant must submit an original photo (DO NOT COPY OTHERS’ WORKS). If other persons appear in photo, entrant must have their written consent. All persons in photo must be 21 years of age or older. Once submitted, photos become the exclusive property of Sponsor. 
 
By submitting a photo, entrant gives permission (and warrants and represents that he/she has obtained all rights necessary to give such permission, including from the photographer, if other than entrant) to Sponsor and hereby grants Sponsor a royalty-free, irrevocable, perpetual, worldwide, sublicensable, non-exclusive license to post entrant's photo and all other information about the entrant contained in the photo on the World Wide Web, and to otherwise use entrant's photo and all other information about the entrant in the photo without compensation as stated in these Official Rules (as solely determined by Sponsor). 
 
Entrant further represents that he/she has fully complied with these rules and that his/her entry photo: (1) does not violate any law or regulation; (2) does not violate or infringe any right of any third party, including but not limited to intellectual property rights, such as but not limited to rights of copyright, trademark or patent, or rights of publicity or privacy. Without in any way limiting the preceding, entrant represents and warrants that he/she has obtained permission from the photographer if not him/herself; (3) is not defamatory, slanderous, libelous, scandalous or obscene as determined in Sponsor’s sole discretion; (4) is entirely entrant's own original work and entrant owns or controls all right, title and interest in the photo, including but not limited to its copyright; (5) has not been submitted in any other competition or promotion; (6) does not contain any virus, bugs, or other deleterious material; (7) does not depict the irresponsible or excessive consumption of alcohol, and (8) without limiting the foregoing, does not contain any material that is protected by copyright other than the copyright owned exclusively by the entrant, including but not limited to product labels that are subject to others’ copyright. 
 
By entering, entrant agrees to indemnify and hold harmless Released Parties (as defined below) from any action or liability resulting from the publishing of his/her photo and/or use of the photo and/or any other information included in any entry.
 
Winners: One winning photo will be selected by September 8, 2017. Ballentine Vineyards will announce the winner via posts on social channels. Winners will be notified via direct message to coordinate prizes. Failure to respond to the initial verification notice within five (5) business days after notification or return of notification as undeliverable after three (3) attempts will result in disqualification.
 
Prizes: Grand Prize winner will receive a Ballentine tasting package and $250 Gift Certificate to use towards our shop!
 
Limitation of Liability: By participating in this Promotion, entrants agree to release and hold harmless Instagram, Twitter and Facebook, Sponsor, administrator, their respective parent, subsidiary, and successor companies, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, shareholders, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the "Released Parties") from: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of prize. No more than the prizes stated above will be awarded.
